OTE LOSES COURT CASE AGAINST DWVC AND TIMELINX
On the 11th January 2002, the Organisation for Timeshare in Europe (OTE) circulated a Press Release entitled “Timeshare Trade Body Sues Seven Companies in Spain” stating that it had filed a case against seven companies in Spain who market or service the holiday club DWVC.
The title of the press release itself was misleading as the actual intention of the suit was to prove in a civil court that the companies named in the litigation should come under the jurisdiction of the European Timeshare Directive and that in not applying the EDT terms and conditions, these companies operated on a basis of unfair competition in comparison to the timeshare companies controlled by the Directive.
The case was finally presented in the Fuengirola Court Nº 1 in front of Judge Maria Angeles Serrano Salazar during the month of February 2003; the aforesaid Judge passed her Sentence on the 11th March 2003.
The claim against ALL OF THE COMPANIES named in the lawsuit was DISMISSED with all costs of the case assessed against the plaintiff i.e. OTE.
